Terms of Service

1. Acceptance of these terms

These terms are an agreement between you and the Kivuli project: the open source project and the maintainers who build and publish Kivuli (together, "Kivuli", "we", "us"). By using the kivuli.xyz website or by installing and using the Kivuli browser extension, you accept these terms. If you do not accept them, do not use the site or the extension.

Kivuli has no accounts and nothing to sign up for; using the website or the software is what constitutes acceptance.

2. The software and its license

The Kivuli extension is free and open source software, licensed under the GNU General Public License, version 3 or any later version (GPL-3.0-or-later). That license, not these terms, governs your rights to copy, study, modify, and redistribute the code. These terms govern your use of this website and of the builds we distribute.

The extension is distributed in exactly one place: github.com/kivuliapp/extension. Builds obtained anywhere else are not ours, and we cannot vouch for them.

3. Self-custody: your keys, your funds

Kivuli is self-custodial. Your wallet's keys are derived from a 12-word recovery phrase created on your device, and they never leave it. Kivuli has no server, holds no keys, and at no point has custody or control of your funds.

That design has hard consequences, and by using the extension you accept them:

  • We cannot recover your recovery phrase. If you lose the phrase and lose access to the device holding your wallet, your funds are permanently inaccessible. No one, including us, can restore them.
  • We cannot reverse, cancel, or modify transactions. Once a transaction is confirmed on the blockchain, it is final.
  • We cannot freeze, seize, or move your funds, and we cannot unlock a wallet whose passcode is lost; only the recovery phrase can restore access.

4. What Kivuli is not

Kivuli is software, not a financial service. We are not a bank, custodian, exchange, broker, dealer, money transmitter, money services business, payment processor, or investment adviser. We do not hold customer funds, execute trades on anyone's behalf, or intermediate payments. The extension constructs transactions that you alone sign and that public blockchain networks, which we do not operate, execute.

Kivuli charges no fees of any kind. Network transaction fees (gas) are paid by you to the blockchain network and are not collected by, shared with, or set by Kivuli.

Nothing on this website or in the software is financial, investment, legal, accounting, or tax advice. Cryptocurrency values are volatile and transactions are irreversible; make your own decisions and consult a qualified professional where you need one.

5. The privacy model, stated plainly

Kivuli gives each site you connect its own wallet address, so the sites you use cannot link your activity across one another. That separation between sites is the whole model.

It is not concealment from the blockchain. Every transaction remains publicly and permanently recorded on-chain and traceable between its actual sender and recipient. Kivuli never pools or commingles funds, yours or anyone else's, and does not obscure the on-chain link between a payment's sender and its recipient.

6. Beta software

Kivuli is a public beta under active development. Features may be incomplete, may change or be removed without notice, and may contain defects, including defects that could result in loss of funds. Treat it accordingly: use amounts you can afford to lose, keep your recovery phrase backed up, and expect rough edges.

7. No warranty

To the maximum extent permitted by applicable law, the website and the software are provided AS IS and AS AVAILABLE, without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the software will be uninterrupted, error free, or secure, or that defects will be corrected. This restates, for your use of the site and our distributed builds, the disclaimer the GPL already applies to the code.

8. Limitation of liability

To the maximum extent permitted by applicable law, Kivuli, its maintainers, and its contributors will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of funds, cryptocurrency, profits, data, or goodwill, arising out of or relating to the website or the software, however caused and under any theory of liability, even if advised of the possibility of such damages. To the same extent, the total aggregate liability of Kivuli, its maintainers, and its contributors for all claims relating to the website or the software will not exceed the amount you paid us for them, which is zero.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

9. Your responsibilities

Using self-custodial software puts you in charge. You agree to:

  • Download Kivuli only from github.com/kivuliapp/extension and verify what you install. Builds from anywhere else may be altered or malicious.
  • Write down your recovery phrase and keep it secure and offline. Anyone who has it controls your funds; no one who lacks it can restore them.
  • Keep your device and browser secure. The extension's protections cannot outlast a compromised device.
  • Comply with all laws that apply to you, including sanctions, export control, tax, and financial regulations. Do not use Kivuli if you are prohibited from doing so, including if you are a sanctioned person or located in a sanctioned jurisdiction.
  • Use Kivuli only for lawful purposes. It may not be used in furtherance of money laundering, terrorist financing, fraud, or any other unlawful activity.

10. Third-party services

The extension and the website interact with services we do not operate: RPC endpoint providers, block explorers, GitHub, the blockchain networks themselves, and any dApp you choose to connect a wallet to. Each has its own terms and policies, and your use of them is between you and their operators. We do not control them, are not responsible for their availability, accuracy, or conduct, and a link from Kivuli is not an endorsement.

11. No obligation to maintain the software

We intend to keep improving Kivuli, but these terms promise no service level and no future development. We may modify, suspend, or discontinue the website or the distribution of the extension at any time, without notice or liability.

Because Kivuli is self-custodial and open source, discontinuation would not take your funds: your recovery phrase and the public blockchain remain yours, and the GPL guarantees the code stays available to run and to fork.

12. Changes to these terms

We may revise these terms from time to time. The current version, with its effective date, is always posted at kivuli.xyz/terms. Revisions apply from the date they are posted, and continued use of the site or the extension after that date constitutes acceptance. If you do not accept revised terms, stop using the site and the extension.

13. Severability and entire agreement

If any provision of these terms is held unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will stay in full force. A failure to enforce any provision is not a waiver of it. These terms, together with the GPL for the code and the Privacy Policy, are the entire agreement between you and Kivuli concerning the website and the software.
